ACCEPTANCE OF TERMS Welcome to EverythingListed! Your submission is subject to these additional terms that supplement the EverythingListed Terms of Service and the EverythingListed advertising guidelines, both incorporated by reference. EverythingListed reserves the right to update and change, from time to time, these additional terms and all documents incorporated by reference. CONDUCT AND OBLIGATIONS You acknowledge that EverythingListed has the right to suspend or terminate your account and refuse current or future use of any EverythingListed service with or without warning if EverythingListed believes you have violated or attempted to violate the rights of others, or have acted inconsistently with the spirit or letter of the EverythingListed Terms of Service or these additional terms. This includes EverythingListed's right to cancel your paid listings. Please note, you will not be entitled to receive a refund if EverythingListed cancels paid listings you have submitted to EverythingListed for the reasons indicated above. PAYMENT TERMS The credit card that you provided in purchasing a paid ad will automatically be billed promptly after your paid ad is submitted. All currency references are in U.S. dollars. Please note, unless EverythingListed provides express notice otherwise, payment for any paid listing is non-refundable and you may not cancel a paid listing after it has been submitted. If your credit card is invalid for any reason, your paid listing will be cancelled immediately. SERVICE PROVIDED "AS IS" The EverythingListed Terms of Service, which apply to your use of EverythingListed, provides that EverythingListed services are provided on an "as-is" and "as available" basis. You will not be entitled to receive a refund for any problems, technical or otherwise, beyond EverythingListed's reasonable control. INVALIDITY OF SPECIFIC TERMS If any provision of these additional terms or any document incorporated by reference is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the such documents remain in full force and effect. LOCATION OF LAWSUIT The EverythingListed Terms of Service, which apply to your use of EverythingListed, provides that both you and EverythingListed agree to submit to the personal and exclusive jurisdiction of the courts located within Holland, Michigan.
